At trial, the arresting officer testified that he followed the client after she pulled out of a bar parking lot. She was observed to be weaving in and out of her lane multiple times. After said swerving incidents, the police officer detained her for further DWI investigation.
The officer claimed that Medlin’s client smelled of alcohol and exhibited slurred speech. She failed sobriety tests and was subsequently arrested for DWI. She later refused a blood test but the officer secured a warrant that ordered the test.
The blood technician testified and the BAC result of 0.156 was admitted into evidence. After deliberation that lasted four and a half hours, the jury could not agree. The defense moved for a mistrial and the Judge granted the motion. After the State produced all evidence and failed to prove the DWI charge, the charge was reduced to Obstruction of a Highway.
This reduction helped to protect the defendant’s future and records and saved her from all the legal consequences that come with a DWI with BAC of over 0.15%.
