As Australian small and medium size businesses face their most trying time since the Global Financial Crisis, the number of Magistrate Court claims in Perth continue to climb.

There is a key difference between a debt recovery or debt collection agency and a lawyer. A lawyer can immediately initiate proceedings in court but a debt recovery agency is not licensed to do so. A debt recovery agent usually sends out a letter of demand and if the debtor does not respond, the agency will still need to instruct a lawyer on behalf of their client to commence recovery through the courts. Going directly to a lawyer who agrees to fixed fee pricing could actually help clients save money.
Lo added that there are good reasons why a creditor should not try to initiate a court proceeding in the Magistrates Court without legal representation, “We have had instances where clients come to us after having not done the proper checks for the debtor company’s registered address or clients who have filed the wrong document only to have be told to redo the entire General Procedure Claim”.
