Earlier today, Imagine Agency announced the launch of its new ADA Compliance Service, set to go live December 17, 2019 for businesses of every size all across the country.
“Website owners are being targeted and sued for a law they aren’t even aware of,” according the Rick Walker the President of Imagine Agency based in Scottsdale, Arizona. Walker continued, “As we begin looking for an ADA Compliance service to cover our site and our client’s sites we couldn’t find an affordable solution so we decided to offer a program ourselves.”
In January 2019, Beyoncé Knowles’ company, Parkwood Entertainment, became the defendant in a class-action lawsuit alleging that it violated the Americans with Disabilities Act (ADA).
The Parkwood lawsuit has been spurring a new wave of digital-era lawsuits, which applies to businesses with 15 or more employees, including state and local governments, and also applies to places of public accommodation. The first half of 2019 saw a 12% increase in ADA Title III lawsuits filed in federal court over the same time period in 2018. The reason: Digital assets, primarily websites that are meant to serve the public, don’t always offer accessibility features for people with disabilities.
Walker stated, “Attorneys are sending out demand letters based on a publicly available website where they can run a pretty rudimentary test. Business owners may not even realize their website bumps up against the ADA until they get a demand letter from a law firm.”
Walker’s Scottsdale-based agency helps businesses make their websites ADA compliant while providing business owners with the ability to better serve those with disabilities. “We are providing a low-cost service to website owners so that they meet Web Content Accessibility Guidelines (WCAG); a set of technical specs that improve the accessibility of content on their sites on desktops, laptops and mobile devices.”
In June of 2019, Domino’s was sued and lost. They’ve petitioned the U.S. Supreme Court to overturn the lower court decision and are still in the midst of litigation.
Walker notes, “By making your digital properties more accessible, you may protect your website from litigation and make it easier for the roughly one in four U.S. adults who live with a disability to do business with you. Basically, every other visitor to your website either has a disability or they’re close to someone with a disability. When you convey you’re a disability-friendly brand, you’re making an impact on a lot of people.”
