International law firm reaches out to the Perth metropolitan community as fears over COVID-19 see a spike in the number of people rushing to get their personal affairs in order.

PERTH, WA – GLP Lawyers International is offering a free consultation to the Perth community to help cash strapped families get their affairs in order. GLP’s Managing Partner for Perth, Nigel Lo remarked that there has been a spike in people wanting to get their estate plan in order in light of the COVID-19 pandemic. “We welcome the increase in people’s awareness about the importance of getting their estate plan in order. This doesn’t just involve getting their Wills drafted but also having an advanced health directive and enduring power of attorney in the event individuals lose their capacity to make decisions on their own”.

“People are increasingly aware of the risks of passing away without a Will. The ramifications can be far reaching. For many people, not having a Will means that they cannot direct how their affairs will be handled; they cannot choose the person they would be most comfortable with as the executor or their estate and they cannot decide how their assets are to be divided according to their personal wishes. When a person dies without a Will, they are considered to have died ‘intestate’ which means their estate will need to be administered and their assets divided between beneficiaries in accordance to the Administration Act 1903 (WA)”.

Mr Lo added that some individuals may wish to exclude some of their relatives who may otherwise inherit portions of their estate, “If you die without a Will, part or all of your estate may pass to someone you did not intend. For example, one case involved the estate of a deceased son who was awarded over $1 million from a wrongful death lawsuit. When the son died, the son’s father – who had not been a part of his son’s life for over 32 years – stood to inherit the entire estate, leaving close relatives and siblings out of the picture”.

“A Will allows parents to make an informed decision about who should take care of their minor children. If both parents pass away suddenly without a Will, the Court will take it upon itself to choose among family members or a state-appointed guardian. Having a Will allows parents to appoint the person they want to raise their children or, better, make sure it is not someone they do not want to raise their children”

Mr Lo is confident that Perth is on the verge of defeating the coronavirus locally but people should not be complacent because “tomorrow is not guaranteed”.
